Special Permits “SP”
A Special Use Permit (“SP”) allows for “unusual and reasonable” land uses within the Agricultural and Rural Districts, as long as the proposed use aligns with the objectives of Hawaiʻi’s Land Use Law and follows Commission guidelines.
Applications are first submitted to the county planning commission where the property is located. If the proposed use involves more than 15 acres, the County’s decision is forwarded to the Land Use Commission (“LUC”) for final consideration. The LUC must issue a decision within 45 days of receiving the full County record.
Petitions must follow the requirements outlined in Chapter 205 and Chapter 15-15.
