A15-798 Waikapu Properties Motion for Modification 2021
On July 2, 2021, Petitioner’s Representative filed a Motion for Modification of Condition 8 (b) of Decision and Order filed on February 26, 2018. Petitioner states that although it proceeded to develop the subject property in accordance with and subject to the Decision and Order and is ready to submit a subdivision application to the County of Maui, a condition of the Decision and Order is different from and inconsistent with a condition imposed by County of Maui as part of the change in zoning, which prevents Petitioner from submitting an application for subdivision, impeding progress on this project.
Petitioner seeks to bring this motion to modify Condition 8 (b) of the D&O (which concerns the mitigation of Project-generated traffic impacts) to be consistent with the condition in the County ordinance that changed the zoning of the subject property.
The Commission is tentatively hearing this motion on September 23, 2021.
