DR20-68 County of Hawai`i’s Petition For Declaratory Order (withdrawn by County of Hawai`i on March 20, 2020)

On February 13, 2020, the Commission received County of Hawaii's Petition for a Declaratory Order that "farm dwellings" may not be used as short-term vacation rentals pursuant to Hawaii Revised Statutes §§ 205-2 and 205-4.5, and Hawai`i Administrative Rules § 15-15-25.

This Petition (DR20-68) was under review and tentatively scheduled to be heard at the LUC meeting set for May 21. 2020 at the Hilo State Office Building.   However, due to the disruption caused by pandemic concerns, the April 2020 meetings were rescheduled and the County of Hawai`i  withdrew their petition.

Docket No. DR20-68 is considered withdrawn and retired.

Once the emergency situation is resolved, the Petition will be resubmitted and identified under Docket No. DR 20-69. Another Petitioner, Linda K. Rosehill et all, is also requesting a Declaratory Order on the same issue and both are included in Docket No. DR20-69. Meeting details will be posted once a reliable date can be established.
