Petitioner Makila Land Co. LLC, filed a petition with the Commission on April X, 2015. The Commission deemed the petition a incomplete filing; several important pieces of information are still required – primary among them is required compliance with Chapter 343, Hawai`i Revised Statutes (HRS). Petitioner requested by motion that the Commission be the approving authority for an Environmental Impact Statement (EIS) and that they be allowed to go straight to preparation of an EIS document. The Commission heard Petitioner’s Motion at its video hearing concurrently on Maui, Hawai`i, O`ahu, and Kaua`i on September 30, 2015. The Commission granted Petitioner’s Motion by Order dated October 22, 2015 (see below under LUC Notices and Orders).
The Petitioner ‘s EIS Preparation Notice (EISPN) was published in the Environmental Notice on November 8, 2015 for a 30-day review and comment period. The deadline for comments on the EISPN was Tuesday December 8, 2015. Comments and responses on the EISPN must be incorporated into the Draft EIS. However, comments received after the December 8, 2015 date were not guaranteed to make it into the Petitioner’s Draft EIS.
