Background

 

On July 19, 2016, RCFC KALOKO HEIGHTS, LLC, Successor Petitioner to Y-O Limited Partnership, filed a Motion for An Order Regarding Satisfaction of Affordable Housing Condition with the Commission to request an order that a donation by Petitioner of a 10.775 acre parcel of land identified as Hawaii Tax Map Key Nos. 7-3-09:32 to Hawaii Island Community Development Corporation, a Hawaii nonprofit corporation, to build housing units to be rented or sold on a self-help or other affordable basis to Hawai`i residents of low or moderate family income satisfies the requirements of Condition 1 of the Commission’s Decision and Order dated January 20, 1983 for Phase I of the Petition Area, as amended by Order Granting Motion for Second Extension of Time to Apply for Redistricting of Phase II and Amending Conditions of the Decision and Order dated January 20, 1983, and June 13, 1990, as entered by the Commission on November 17, 1992 for Phase I of the Petition Area.

This Motion is scheduled for hearing on Thursday October 13, 2016 in Kona, Hawai`i.  Agency comments on the Motion are due by close of business on Friday September 30, 2016, and will be posted at that time.
